workers' compensation insurance company for his employer, denied his workers' compensation claim. Under
Virginia law, unless you die in an on-the-job accident that no one witnesses, you do not receive workers' comp payments.
The man, Mike Gentry, has suffered from significant lost wages and is now facing a pile of medical bills for his
brain injury, his hip injury, and his shoulder injury. He is also struggling with
double vision.
A bill that would change this law was brought to the
Virginia General Assembly this year that would change the "death presumption" clause to include those who suffer severe brain injuries in un-witnessed work accidents. But Bill 821 was defeated 11-4 in committee.
