Northern Virginians: Don't Text and Drive in Road Work Zones

This week, Northern Virginia police warned drivers that, due to the tollbooth construction and other roadwork in the area, drivers should be especially cautious and refrain from using their cell phones. Already this summer, multiple road construction zone traffic accidents have been blamed on distracted driving and mobile phone use – accidents and injuries that are easily preventable.

Why is distracted driving even more dangerous in road construction zones?

Narrow lanes. Distracted drivers will often drift out of their lanes onto the shoulder, but have time to correct their mistake. In construction areas, where lanes can be narrow, distracted drivers may drift into road equipment or even workers.

Shifting lanes. If you are talking on the phone or text messaging, you might not notice the odd lane shifts that are often present near roadwork sites.

Stop-and-go traffic. The majority of construction zone accidents are rear-end accidents – a car or truck doesn’t slow with the flow of traffic or is distracted when the car in front of them brakes for workers.

Pedestrian workers. Those most in danger in construction zones are the road workers – men and women who put their lives at risk to make our roads safer. Taking your eyes away from the road to use your mobile phone could mean drifting into a worker or a construction vehicle with a worker inside.

Have you been involved in a Virginia road construction accident or a Virginia distracted driving accident? The new workers’ comp laws will better protect employees who suffer serious brain injuries in on-the-job accidents but who can’t remember the circumstances of their accident.

Before the law, workers who were well enough to testify but who were not well enough to remember their brain injury could be denied workers’ compensation benefits if no one else witnessed their accident.

Two examples of why the loophole needed to be closed
Many lawmakers believe the law is needed for people like Herman Blair, a construction worker who suffered a fractured skull and brain injury when he fell from a roof during his workday. Blair was initially denied benefits because he could remember long-term information about himself, such as his address, but could not recall the day of the accident.

In another example, satellite dish installer Mike Gentry fell from a roof in Roanoke County while on a job. Even though he fell while helping a customer, no one witnessed the fall and Gentry could not remember the accident due to the brain injury he sustained. Because no one could testify, he was denied the workers’ compensation benefits he needed to support his family.

Virginia workers’ compensation attorneys
It is vital for injured workers to get financial support in the wake of an on-the-job accident. Redelmeier, about 13 more fatal car accidents take place on the last day to file your taxes than on surrounding days. Redelmeir analyzed 30 years of United States crash data from 1980 to 2009 to come to the conclusion that it’s more dangerous to be on the road when taxes are due. During the time period studied, which focused on tax day, a week before tax day, and a week after tax day, researchers found that an average of 213 deadly crashes take place on “normal” days, while 226 fatal crashes were recorded on average on tax day.

The study’s authors believe that stress is a big factor when it comes to explaining their findings – many are thinking about financial worries in mid-April, while others are simply rushing to finish their paperwork. The study took gas prices, health care access, vehicle safety technology, and other factors into account.

This year, the last day to file your taxes for 2011 is Tuesday, April 17.

Virginia car accident lawyers
If you have been injured in a Virginia traffic accident that was not your fault, you could deserve compensation for your injuries, medical bills, and other damages. The driver of the car, as well as eleven students, was injured in the accident, while the truck driver was cited for tailgating by police.

In a second accident, a commercial truck transporting hay on I-95 outside of the city overturned, dumping its load and causing traffic along the coast’s main artery.

On the road with Ron Floyd
Floyd is all too familiar with hazards like tailgating, speeding, and reckless driving. While some truckers suffer from these moving violations and traffic hazards, he says that all drivers can be hazards on the road. However, because of a truck’s weight and size, truckers have to be extra vigilant due to how it takes them to slow or stop their big rig. Trucks, he said, are hard to maneuver and have larger blind spots.

Floyd also pointed out that there are more trucks on the road in the spring, when fresh produce is being shipped up and down the coast.

Virginia truck accident lawyers
Have you been injured in a Richmond truck accident that may have involved reckless driving, tailgating, or speeding? The bill passed by a vote of 20-19 in the Senate and by a vote of 70-26 in the House.

While those who support the bill say that the new workers’ comp law will stamp out redundancy in the wake of shipyard worker accidents, opponents to the bill believe that it will leave some shipyard workers without workers’ comp coverage in the event of a serious injury. Currently, workers filed two claims after an on-the-job accident: one Virginia workers’ compensation claim and one federal Longshore and Harbor Workers' Compensation Act claim. In most cases, the latter form of coverage is better for most injured workers.

The bill will affect about 1,800 workers, though some shipyard employers say that only about five perfect of those workers would be affected by the new legislation.

Virginia workers’ compensation attorney

After a serious injury at work, it is vital that you and your family receive the support you need during your recovery. There were 32,885 traffic accident fatalities on the roads last year – a number not seen since 1949, a year when there were fewer roads, fewer miles traveled, and fewer people.

But why are United States traffic accident rates so low? Traffic safety experts say that while a number of different organizations and governments are trying to take credit, the low crash rates have three main causes:

Cars are safer than ever before. Cars in 1959 didn’t have seatbelts, airbags, high-tech brakes, modern bumpers, or crash avoidance technology. Even when accidents happen, they are less likely to involve serious injury or death.

Roads are safer and better designed. Advances in pavement technology, rumble strips, better barriers, more lights, and better signage all mean that fewer people crash due to road conditions.

Drivers are making better decisions. Drivers and passengers are both buckling up at record rates, while drivers are making better decisions about drinking and driving. Tougher DUI laws in many states may also contribute to lower crash rates.

Of course, it is important to remember that while traffic accident rates are low, over thirty thousand people across the country lost their lives in traffic accidents last year, and those numbers can still improve.

Have you been injured in a Virginia car accident? While the city initially claimed that the fatal on-the-job accident was caused by a violation by the worker, the state agency found that the city endorsed the dangerous action that killed the man.
This winter, 51-year-old Jerry Holton was working on a Heil Formula 7000 truck when the vehicle's trash compactor became jammed with debris. Holton climbed into the back of the truck to clean off the blade when the compactor activated, crushing the man. An investigation into the tragic accident found that the city of Norfolk was in violation of 19 different safety regulations in connection with the worker death - and that it was city policy for sanitation workers like Holton to clear the blades of the trash compactor.

According to an investigation by the Virginian-Pilot, three of the main violations included:

Workers had not been warned of the dangers of getting into the back of the truck.

Holton had not been trained to drive the truck that he was driving that day.

The safety system on the truck had not been tested that morning as was required.

Perhaps the most shocking part of the fatal Virginia worker accident is that the report was not given to Holton's family or brought to the attention of city councilmen.

If your loved one has been injured or killed in an on-the-job accident in Norfolk, it is absolutely vital that you understand how the accident took place and who was at fault. Groups like these have been asking for a heat exposure safety standard since 1972.

According to a Public Citizen press release, over five hundred workers have died of heat-related causes in the last two decades while an estimated 43,000 more workers have missed at least one day of work due to on-the-job heat-related medical issues. However, despite these numbers, the OSHA has not implemented a safety standard for heat exposure. The OSHA argues that heat exposure is covered in more general standards regarding safe work conditions.

Heat exposure has a number of serious consequences, including heat exhaustion, heat stroke, and even death. Workers are especially susceptible to these issues as they are often laboring for hours while wearing protective gear. The workers who are most often affected by extreme heat exposure are construction workers and agricultural workers.

If you have been harmed by extreme heat exposure on the job, it is important that you understand your rights - and that your employer is aware of the dangers of exposing workers to dangerous conditions. Three were on-the-job construction workers.
According to WAVY Channel 10, three road workers were in a truck going in reverse in the westbound lanes of I-64 and picking up traffic cones from a construction site when the vehicle was struck by an approaching sedan. The truck was owned by the Virginia Department of Transportation (VDOT) and the workers involved in the accident were contractors from TME.

Witnesses to the Virginia worker accident say that the approaching car was speeding in the moments before it struck the truck and that the driver suddenly veered out of the left lane and into the truck. Two of the TME workers were thrown from the vehicle and all three were injured. Three people in the car that allegedly caused the on-the-job accident were also injured. All six injured people were transported by ambulance to Sentara Norfolk General Hospital.

Virginia state police say that both speeding and alcohol consumption were factors in the crash, though they have yet to charge the driver of the sedan.

Just last week, Virginia State Troopers reminded residents that a large amount of roadwork would be taking place across the state in the coming months and that it was extremely important that drivers slow down and stay alert in road work zones. This construction zone accident is a sad reminder we must do a better job at keeping our construction workers safe.

Have you or a loved one been injured in a Virginia worker accident? There was recently a workers' compensation case in Virginia that illustrated the importance of establishing a relationship between your injury and your lost wages.
Earlier this year, a manufacturing worker for the Utility Trailer Manufacturing Company was injured at work and received medical benefits, temporary total disability benefits, and permanent partial disability benefits in the wake of his accident. Later, after he returned to his job, his entire line was furloughed for a week due to a drop in demand. The worker then sought lost wages benefits for the week without pay.

While his employer argued that there was not a significant connection between his injury and the loss of wages since his coworkers also lost pay, the worker contended that a causal relationship existed. The Virginia Court of Appeals sided with the employer, finding that since other employees suffered the same experiences despite a lack of injuries, the injured worker should not be granted benefits.

When fighting to secure benefits for your Virginia workers' compensation claim, it is vital that you establish a causal relationship between your injury and any monetary losses. These models can then help police accurately calculate the speed and trajectory of the vehicles involved in the accident – as well as paint a clearer picture for jurors in the case of a trial.

Several different jurisdictions will be sharing the two units to make certain that their usefulness is maximized across Virginia.

"We otherwise could not afford this type of equipment. It will be shared among two regional crash teams and others as needed. It's equipment that we'll be able to use to be more efficient, more effective," Chief Jim Day of the Bedford City Police told a local news source.

The hope is that the two pieces of technology will help police better determine who is at fault for an accident and whether or not charges should be filed.

Have you been injured in a Virginia traffic accident? But instead of plowing through the workers, the driver hit a cushion vehicle placed on the outer edge of the construction zone by the Virginia Department of Transportation. While the trucker tragically died in the accident after his truck cab ignited, no construction workers were seriously injured.

What exactly is a cushion vehicle? Because so many construction workers are killed in road work zones each year by passing vehicles, the Virginia Department of Transportation (VDOT) will often place an angled truck with flashing lights at the beginning of a work zone along roads. This truck not only warns oncoming cars to slow down and be wary of workers, but also acts as a physical barrier between cars using the interstate and workers on the shoulder. Drivers that drift out of their lane, lose control of their car, or drive under the influence of drugs and alcohol will hit the cushion car before slamming into workers.

Construction workers in Virginia already have one of the most dangerous jobs in the country because of their exposure to heavy equipment and falling objects – and road construction workers face even more dangers because of careless passing vehicles. Do them a favor and prevent accidents by slowing down and staying aware while driving in construction zones.
