Virginia Workers’ Compensation Statute Of Limitations | VA Workers' Comp Lawyer

This month we brought you the story of Virginia police officer Kurt Beach who suffered from liver failure due to the Hepatitis C infection he contracted while trying to resuscitate a baby while on the job in 1988. Although his health problems stemmed directly to an on-the-job event, Beach did not receive workers’ compensation because he filed his claim after the two-year limit. Now Beach has received a life-saving liver transplant last year as well as money from the state of Virginia to help cover his medical bills – but he now wants to change Virginia’s workers’ compensation statute of limitations.

As it stands, workers in Virginia have two years from the date of their injury or incident to file for workers’ compensation benefits. Even if you did not know about your injury or illness until years later, your claim is no longer valid. This is why it is extremely important to move forward with your workers’ compensation case as soon as you are aware of the problem.

Last year, Virginia lawmakers considered changing the law in order to lengthen the filing time in some cases. However, the law did not make it out of committee since it is unpopular with businesses and companies that would have to pay more money to injured workers. Now, however, Beach and his thousands of supporters are trying to once again lengthen the window for filing a workers’ compensation claim, giving workers that contact infectious diseases and other conditions more years to discover their condition and file a claim.
